MICROPINNACLE TECHNOLOGY CORPORATION, (hereafter referred as “MTC” or “We”) is committed to protect your privacy and ensure that all personal data collected from you are processed according to the fulfillment of the specified purpose pursuant to R.A. 10173 (Data Privacy Act of 2012).

 

Data Protection

We appreciate you visiting our website and your interest in the products and services we offer. Protecting your personal data is very important to MTC. In this Privacy Statement, we explain how we collect your personal information, what we do with it, for what purposes and on what legal foundation we do so, and what rights you have on that basis. We will also refer you to the MTC Privacy Manual.

Our Privacy Statement on the use of our website and the MTC Privacy Manual do not apply to your activities on the website of social networks or other providers that can be accessed using the links on our website. Please read the data protection provisions on the website of those providers.

Collecting and processing of your personal data

Whenever you visit our website, we store certain information about the browser and operating system you are using; the date and time of your visit; the status of the interaction (e.g. whether you were able to access the website or received an error message); the usage of features on the website; any search phrases you entered; how often you visit individual website; the names of the files you access; the amount of data transferred; the web page from which you accessed our website; and the web page you visited after visiting our website, whether by clicking links on our website or entering a domain directly into the input field of the same tab (or window) of the browser in which you have our website open. In addition, we store your IP address and the name of your Internet Service Provider for seven (7) days. This is for security reasons; in particular, to prevent and detect attacks on our website or attempts at fraud.

We only process other personal data if you provide this data, e.g. as part of a registration, contact form, chat, survey, or for the execution of a contract, and even in these cases only in so-far as this is permitted to us on the basis of a consent given by you or in accordance with the applicable legal provisions of the Data Privacy Act of 2012.

You are neither legally nor contractually obligated to share your personal information. However, certain features of our website may depend on the sharing of personal information. If you do not provide your personal information in such cases, you may not be able to use those features, or they may be available with limited functionality.

Purpose of collection

We use the personal information collected during your visit to our website to make using them as convenient as possible for you and to protect our IT systems against attacks and other unlawful activities.

If you share additional information with us – for example, by filling out a registration form, contact form, chat, survey, or to execute a contract with you – we will use that information for the designated purposes, purposes of customer management and – if required – for purposes of processing and billing and business transactions within the required scope in each instance.

MTC, pursuant to and in furtherance of its business model, collects a wide range of data for the purpose of:

  4. Accreditation of Service Providers / contractors
  5. Negotiations and implementation of projects

In addition, we use personal data to the extent that we are legally obliged to do so (e.g., storage for the fulfilment of commercial or tax-related retention obligations, release in accordance with official or judicial orders, e.g. to a law enforcement authority).

Types of personal data we collect The types of personal data we collect and share depends on the type of process or service you request from us. Transfer of Personal Information to Third Parties; Social Plugins; Use of Service Providers

MTC website may also contain an offer to direct you to third parties. If you click on such an offer, we transfer data to the respective provider to the required extent (e.g. information that you have found this offer with us and, if applicable, further information that you have already provided on our website for this purpose).

When we use social media plug-ins on our website from social networks such as, but not limited to Facebook, Linkedin, TikTok, and YouTube, we integrate them as follows:

  1. When you visit our website, the social media link or plug-ins are deactivated, i.e. no data is transmitted to the operators of these networks. If you want to use one of the networks, click on the respective social plug-in to establish a direct connection to the server of the respective network.
  2. If you have a user account on the network and are logged in when you activate the social plug-in, the network can associate your visit to our website with your user account. If you want to avoid this, please log out of the network before activating the social media link or plug-in. A social network cannot associate a visit to MTC website until you have activated an existing social plug-in.
  3. When you activate a social media plug-in, the network transfers the content that becomes available directly to your browser, which integrates it into our website. In this situation, data transmissions can also take place that are initiated and controlled by the respective social network. Your connection to a social network, the data transfers taking place between the network and your system, and your interactions on that platform are governed solely by the privacy policies of that network. The social plug-in remains active until you deactivate it or delete your cookies.

If you click on the link to an offer or activate a social media plug-in, personal data may reach providers in countries outside the Philippine area that may not guarantee an “adequate level of protection” for the processing of personal data in accordance with the Philippine Data Privacy standards. Please remember this fact before clicking on a link or activating a social plug-in and thereby triggering a transfer of your data.

We also use qualified service providers (e.g., IT service providers, software providers) to operate, optimize and secure our website. We only pass on personal data to the latter insofar as this is necessary for the provision and use of the website and its functionalities, for the pursuit of legitimate interests, to comply with legal obligations, or insofar as you have consented hereto.

Ways we collect data

There are different ways on how we collect data from you. Your personal data is collected primarily through the following channels:

When you access our website that requires you to submit certain data pursuant to a function, process or transaction

  2. When you submit required documents to us for processing, verification and documentation
  3. When you fill-out a form and submit it to us for verification
  4. When you interact with our employees via telephone calls, emails, letters, fax, face to face meetings
  5. When you are contacted by us via telephone call or notified via email
  6. When a complaint is filed due to address issues

How we share data

If you have availed any of the services we provide, accessed our website, or pursuant to a contract, your information is basically shared to our service providers, affiliates, contractors, and partners. 

We also share your information amongst different government agencies of the Republic of the Philippines who may be involved in verification and connected with any process.

Protection of data

We take technical and organizational security measures in order to protect your information managed by us from being tampered with, lost, destroyed or accessed by authorized individuals. We are continuously improving our security measures in line with technological advancements.

To ensure the privacy and security of personal data and transaction information, we have set forth the following: 

  1. We deploy intrusion detection systems, firewalls, encryption systems and other internal controls which are meant to safeguard, physically and logically, all our servers and information systems.
  2. We have an inhouse Network Management Section, which oversees, manages and secures the maintenance of the whole facility.
  3. Our office is equipped with a Biometric Door Access Control System, only authorized personnel can enter the facility.
  4. We have a designated Data Privacy Officer whose job is to ensure adherence to data privacy principles and implementation of safeguards for data protection.
  5. We enforce role-based access control (RBAC) or role-based security to restrict access to only qualified and authorized employees to handle your personal data.
  6. We require users of our online systems to pass through the Log-in authentication process. They have to undergo account registration, data validation and email verification before acquiring username and password. 
  7. We require our off-shore data center provider (Google Drive) to keep your information secure, treating it responsibly, and keeping us in control.

Your Data Privacy rights

Under the Data Privacy Act of 2012, you have the following rights:

MTC’s decision in providing and accepting requests in line with the rights stated in the Data Privacy Act of 2012 is always subject for evaluation and approval according to our applicable policies and regulation.

Retention and disposal of personal data 

Your IP address and the name of your Internet service provider, which we store for security reasons, are deleted after Seven (7) days. Moreover, we delete your personal information as soon as the purpose for which it was collected and processed has been fulfilled. Beyond this time period, data storage only takes place to the extent made necessary by the legislation, regulations or other legal provisions to which we are subject in the Philippines or by legal provisions in third-party countries if these have an appropriate level of data protection. Should it not be possible to delete data in individual cases, the relevant personal data are flagged to restrict their further processing. We store your personal data up to a maximum of Three (3) years from the completion of the purpose of the collection, unless required or requested by the data subject to be disposed or deleted.

Your obligation in providing your personal data 

You must ensure that the personal information submitted to us are true, accurate, complete, and updated, as per your latest contract. You should guarantee that the uploaded and submitted documents are faithful reproduction of the original. You are also responsible for maintaining the confidentiality of your username, password, account details, and are fully responsible for the content, accuracy of information and all activities that occurred under your password and/or account.

Consent 

By submitting/providing/supplying/encoding the accomplished forms and the different data required by our online system(s) and those submitted to our office, you are consenting/agreeing/authorizing MTC to process your personal information based on the purpose provided in this notice.

You also authorize MTC to disclose your data to the service providers, clients and governments, for the purposes mentioned above and those necessary to render the services we provide.

Amendment of data privacy statement

We may amend this Data Privacy Statement if there are changes and improvements in the Data Privacy Act as well as in our internal policies. We will keep you updated by publishing the updated version on our website.
